Article 1 – Parties

This contract is established as a distance selling agreement between S Moon Fragrance (hereinafter referred to as the “Seller”) and the user who makes a purchase through our website (hereinafter referred to as the “Buyer”).

Article 2 – Subject of the Contract

This contract regulates the terms of sale, rights, and obligations for fragrance devices and products purchased online by the Buyer.

Article 3 – Formation of the Contract

The contract is considered concluded when the Buyer orders the products and completes the payment.
The Seller will send a confirmation email to the Buyer upon accepting the order.

Article 4 – Product Price and Payment

• Product prices are as stated on the website and include VAT.
• Payment methods: credit card, bank transfer, or secure virtual POS.

Article 5 – Delivery

• Products are shipped to the address provided after order confirmation.
• Estimated delivery times are stated on the product page.
• Shipping costs and delivery terms are provided on the website.

Article 6 – Right of Withdrawal and Returns

• The Buyer may withdraw from the contract within 14 days without providing any reason, in accordance with the Consumer Protection Law No. 4077 and Distance Selling Regulations.
• To exercise the right of withdrawal, the product must be returned unused, in its original packaging, and with all accessories.
• In case of withdrawal, the amount paid will be refunded to the Buyer within 7 business days after the product reaches the Seller.

Article 7 – Cases Where Withdrawal Cannot Be Exercised

• Personalized products (e.g., products with a name or custom fragrance)
• Fragile, perishable, or hygiene-sensitive products that cannot be returned

Article 8 – Obligations of the Parties

Seller:

• Obliged to deliver the products in accordance with the contract.
• Responsible for protecting customer information.

Buyer:

• Obliged to pay the product price within the specified period and method.
• Responsible for taking necessary care to prevent damage when returning products.

Article 9 – Dispute Resolution

• Any disputes between the parties shall first be attempted to be resolved through mutual agreement.
• If unresolved, the laws of the Republic of Karadağ and the competent courts shall apply.

Article 10 – Acceptance of the Contract

By confirming the order, the Buyer is deemed to have read, understood, and accepted this Distance Selling Contract.
